These Terms of Service and Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," "Traveler," "Customer," or "User") and Glidova Inc. ("Glidova," "we," "us," or "our").

These Terms govern your access to and use of:

  • the Glidova website;

  • the Glidova Android mobile application;

  • the Glidova iOS mobile application;

  • Glidova mobile and web booking interfaces;

  • Glidova customer-support services;

  • and any related products, software, applications, websites, communications, or services made available by Glidova.

Collectively, these are referred to as the "Glidova Services" or "Services."

PLEASE READ THESE TERMS CAREFULLY BEFORE USING GLIDOVA.

THESE TERMS CONTAIN IMPORTANT PROVISIONS CONCERNING DISCLAIMERS, LIMITATIONS OF LIABILITY, INDEMNIFICATION, DISPUTE RESOLUTION, ARBITRATION, AND WAIVER OF CLASS ACTIONS.

BY ACCESSING, SEARCHING, REGISTERING, MAKING A BOOKING, MAKING A PAYMENT, DOWNLOADING OR USING OUR MOBILE APPLICATION, OR OTHERWISE USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS.

If you do not agree with these Terms, do not use the Glidova Services.

1. ABOUT GLIDOVA

Glidova operates an online travel agency and travel technology platform through which users may search, compare, request, reserve, and purchase travel products and services.

Depending upon availability, such products may include:

  • flights and airline tickets;

  • hotels and other accommodation;

  • rental cars;

  • activities;

  • attractions;

  • experiences;

  • excursions;

  • tours;

  • and related travel services.

Except where Glidova expressly identifies itself as the direct provider of a particular service, Glidova is an intermediary and is not the actual provider, operator, carrier, hotel, rental-car company, tour operator, activity provider, transportation company, insurer, or other supplier of the Travel Service.

2. THIRD-PARTY TRAVEL SUPPLIERS

Travel products displayed or booked through Glidova are generally supplied, operated, fulfilled, or controlled by independent third parties ("Travel Suppliers").

Travel Suppliers may include:

  • airlines;

  • hotels;

  • resorts;

  • accommodation providers;

  • car rental companies;

  • tour operators;

  • activity providers;

  • attractions;

  • destination management companies;

  • consolidators;

  • wholesalers;

  • bedbanks;

  • global distribution systems;

  • reservation systems;

  • flight aggregators;

  • car aggregators;

  • payment processors;

  • insurance providers;

  • and other travel service providers.

Travel Suppliers are independent entities.

Except where applicable law expressly provides otherwise, Glidova is not responsible for the acts, omissions, representations, warranties, breaches, negligence, misconduct, operational decisions, failures, delays, or insolvency of any Travel Supplier.

3. GLIDOVA ACTS AS AN INTERMEDIARY

By making a booking through Glidova, you authorize Glidova to facilitate a transaction between you and the applicable Travel Supplier.

Unless specifically stated otherwise:

  1. Glidova does not own or operate aircraft;

  2. Glidova does not operate airlines;

  3. Glidova does not own or manage hotels;

  4. Glidova does not operate rental vehicles;

  5. Glidova does not conduct activities, tours, or excursions;

  6. Glidova does not control airline schedules;

  7. Glidova does not control hotel operations;

  8. Glidova does not control rental-car availability;

  9. Glidova does not control activity operators;

  10. Glidova cannot guarantee the continued availability of inventory displayed by a Travel Supplier.

The contractual relationship for the actual Travel Service may be directly between you and the applicable Travel Supplier.

Additional supplier terms may apply to your booking.

4. SUPPLIER TERMS AND CONDITIONS

Every Travel Service may be subject to additional terms imposed by the applicable Travel Supplier.

These may include:

  • airline conditions of carriage;

  • fare rules;

  • baggage rules;

  • hotel cancellation rules;

  • hotel check-in requirements;

  • resort fees;

  • car rental terms;

  • minimum driver age requirements;

  • security deposit requirements;

  • fuel policies;

  • activity participation conditions;

  • cancellation penalties;

  • no-show penalties;

  • supplier refund rules;

  • identification requirements;

  • health requirements;

  • and other supplier-specific restrictions.

By completing a booking, you agree to comply with the applicable Travel Supplier's terms.

Where supplier terms conflict with these Terms regarding the supplier's Travel Service, the supplier's terms may control that Travel Service, except where prohibited by applicable law.

5. BOOKING REQUESTS ARE SUBJECT TO CONFIRMATION

Information displayed during a search is not necessarily a guaranteed offer.

A booking is considered confirmed only after:

  • the applicable supplier accepts the reservation;

  • required payment authorization is successfully completed;

  • inventory remains available;

  • and Glidova or the applicable supplier issues a valid booking confirmation, ticket, voucher, or reservation reference.

Submitting a booking request does not guarantee confirmation.

Inventory may become unavailable between search and booking confirmation.

6. AIRFARES, HOTEL RATES AND OTHER PRICES MAY CHANGE

Travel prices are dynamic.

Prices may change due to circumstances including:

  • supplier inventory changes;

  • airline fare changes;

  • exchange-rate fluctuations;

  • tax changes;

  • availability changes;

  • pricing updates;

  • changes in fare class;

  • hotel inventory updates;

  • supplier system updates;

  • technical delays;

  • or expired cached search results.

Until a reservation is successfully confirmed and ticketed where applicable, a displayed price may change.

If a material price change occurs before confirmation, you may be asked to approve the updated amount before proceeding.

7. PRICING ERRORS

Glidova seeks to display accurate pricing but errors may occur.

Examples include:

  • incorrect supplier data;

  • technical errors;

  • currency conversion errors;

  • typographical errors;

  • incorrect taxes;

  • system configuration errors;

  • incorrect availability;

  • incorrect fare loading;

  • obviously incorrect hotel rates;

  • or other pricing mistakes.

If an obvious or material pricing error occurs, Glidova or the Travel Supplier may, to the extent permitted by law:

  • correct the price;

  • reject the booking;

  • cancel an affected unfulfilled booking;

  • or offer you the opportunity to continue at the correct price.

Nothing in this section limits any non-waivable rights available under applicable law.

8. TAXES AND FEES

Displayed prices may include or exclude certain taxes, service fees, supplier fees, local charges, or mandatory destination charges depending upon the Travel Service and applicable display requirements.

You may be responsible for additional charges payable directly to a supplier, including where applicable:

  • hotel resort fees;

  • tourism taxes;

  • local city taxes;

  • parking charges;

  • deposits;

  • optional baggage charges;

  • seat-selection fees;

  • rental-car deposits;

  • fuel charges;

  • tolls;

  • airport fees;

  • young-driver fees;

  • additional-driver fees;

  • or optional services.

Glidova will display fees and charges where required and where such information is provided to Glidova.

9. CURRENCY CONVERSION

Glidova may display prices in multiple currencies.

Where currency conversion is provided, converted amounts may be estimates unless expressly stated otherwise.

Your bank, card issuer, payment provider, or supplier may use a different exchange rate and may impose:

  • foreign transaction charges;

  • currency conversion charges;

  • cross-border fees;

  • or other banking charges.

Glidova is not responsible for fees independently imposed by your bank, card issuer, or financial institution.

10. PAYMENT

Payments may be processed through third-party payment gateways or processors.

Glidova does not store complete payment-card information.

You authorize the applicable payment processor, Glidova, and/or Travel Supplier, as appropriate, to charge amounts associated with your confirmed transaction.

You represent that:

  • you are authorized to use the payment method;

  • the payment information you submit is accurate;

  • sufficient funds or credit are available;

  • and the payment is not fraudulent.

A booking may be canceled or remain unconfirmed if payment cannot be successfully authorized or settled.

11. PAYMENT AUTHORIZATION DOES NOT ALWAYS MEAN BOOKING CONFIRMATION

A temporary authorization or pending charge may appear on your payment account before booking confirmation.

Such an authorization does not itself prove that the Travel Service has been confirmed.

Where a booking fails after authorization, release of a payment hold may depend on:

  • the payment gateway;

  • card issuer;

  • bank;

  • payment network;

  • and applicable processing timelines.

Glidova cannot control how quickly a third-party financial institution releases a pending authorization.

12. FRAUD PREVENTION

Glidova may use fraud-prevention and transaction-verification procedures.

We may:

  • reject a transaction;

  • place a booking under review;

  • request additional verification;

  • require identity confirmation;

  • contact you;

  • or cancel a transaction,

where reasonably necessary to prevent suspected fraud, misuse, unauthorized transactions, or security threats.

Glidova is not liable for delays caused by reasonable fraud-prevention procedures except to the extent liability cannot be excluded by law.

13. CHARGEBACKS AND PAYMENT DISPUTES

Before initiating a payment dispute or chargeback, you should contact Glidova and allow a reasonable opportunity to investigate the matter.

Fraudulent, abusive, or knowingly false chargebacks may result in:

  • suspension of access;

  • cancellation of pending reservations where legally permissible;

  • recovery efforts;

  • or other lawful remedies.

Nothing in this section prevents you from exercising legitimate rights provided by your card issuer or applicable law.

14. USER RESPONSIBILITY FOR TRAVELER INFORMATION

You are responsible for ensuring that all information entered during booking is correct.

This includes:

  • traveler name;

  • passenger name;

  • date of birth;

  • gender where required;

  • passport information;

  • nationality;

  • telephone number;

  • email address;

  • travel dates;

  • destination;

  • and other required details.

Passenger names should match applicable government-issued identification or travel documents.

Glidova is not responsible for losses caused by incorrect information supplied by you.

Such losses may include:

  • denied boarding;

  • inability to check in;

  • booking cancellation;

  • ticket reissuance charges;

  • fare differences;

  • supplier penalties;

  • missed travel;

  • or inability to obtain a refund.

15. PASSPORTS, VISAS AND IMMIGRATION REQUIREMENTS

You are solely responsible for determining and satisfying all travel-document requirements.

These may include:

  • passports;

  • visas;

  • transit visas;

  • entry permits;

  • exit permits;

  • immigration documents;

  • Electronic Travel Authorizations;

  • vaccinations;

  • customs documents;

  • health certificates;

  • and other governmental requirements.

Glidova may provide general travel information as a convenience, but such information is not legal, immigration, medical, or governmental advice.

Requirements may change without notice.

You should independently verify requirements with the relevant:

  • embassy;

  • consulate;

  • immigration authority;

  • government agency;

  • airline;

  • or other competent authority.

16. PASSPORT VALIDITY

Many destinations require a passport to remain valid for a specified period beyond the intended travel date.

It is your responsibility to confirm that:

  • your passport is valid;

  • sufficient blank pages are available;

  • your passport meets destination requirements;

  • and your travel documents match the information in the reservation.

Glidova is not responsible for denied boarding, denied entry, deportation, detention, fines, additional expenses, or other consequences caused by insufficient or invalid travel documentation.

17. HEALTH, VACCINATION AND MEDICAL REQUIREMENTS

You are responsible for determining whether any destination or Travel Supplier imposes:

  • vaccination requirements;

  • medical documentation requirements;

  • health declarations;

  • quarantine requirements;

  • insurance requirements;

  • fitness-to-travel requirements;

  • or other public-health conditions.

Health-related information provided through Glidova is informational only.

Travelers with health conditions should consult an appropriate licensed medical professional.

18. TRAVEL INSURANCE

Unless expressly stated otherwise, travel insurance is not automatically included with your booking.

Glidova strongly recommends that travelers independently evaluate whether appropriate insurance is needed for risks such as:

  • cancellation;

  • medical emergencies;

  • hospitalization;

  • missed connections;

  • baggage loss;

  • travel delays;

  • supplier insolvency;

  • accidents;

  • evacuation;

  • and other unexpected events.

Where insurance products are made available through Glidova, the insurance provider's policy terms control.

Glidova is not the insurer unless explicitly stated otherwise.

19. FLIGHT SCHEDULES

Flight times, aircraft, routes, terminals, gates, and schedules may change.

Airlines control their own flight operations.

Glidova does not guarantee:

  • flight departure times;

  • arrival times;

  • aircraft type;

  • seat assignments;

  • route;

  • terminal;

  • gate;

  • connection times;

  • or operational performance.

Travelers should independently verify current flight details before departure.

20. FLIGHT DELAYS, CANCELLATIONS AND DISRUPTIONS

Glidova is not responsible for airline operational decisions or events including:

  • flight delays;

  • cancellations;

  • schedule changes;

  • diversions;

  • overbooking;

  • denied boarding;

  • missed connections;

  • aircraft substitutions;

  • mechanical issues;

  • crew shortages;

  • weather disruptions;

  • airport closures;

  • security events;

  • air traffic control restrictions;

  • strikes;

  • or other airline disruptions.

Where applicable law gives you a statutory right to a refund or other remedy, nothing in these Terms eliminates that right.

Where Glidova is legally responsible for processing a qualifying refund because of its role in the transaction, Glidova will process the refund in accordance with applicable law.

21. THE 24-HOUR AIRLINE CANCELLATION RULE

Do not assume that every flight booking made through Glidova may be canceled without penalty within 24 hours.

The U.S. airline 24-hour reservation/refund requirement does not necessarily apply in the same manner to tickets purchased through online travel agencies.

Any voluntary Glidova cancellation policy or supplier cancellation policy displayed during booking will apply, together with rights mandated by applicable law.

Travelers should review the applicable fare rules before purchase.

22. AIRLINE BAGGAGE

Airlines establish and enforce their own baggage rules.

These may include:

  • baggage allowances;

  • cabin baggage restrictions;

  • checked baggage fees;

  • excess baggage charges;

  • weight restrictions;

  • size restrictions;

  • prohibited articles;

  • sports equipment rules;

  • and liability limits.

Glidova is not responsible for:

  • lost baggage;

  • delayed baggage;

  • damaged baggage;

  • theft from baggage;

  • baggage fees;

  • or airline baggage handling.

Claims regarding airline baggage generally must be made directly with the airline, subject to applicable law.

23. SEAT ASSIGNMENTS AND SPECIAL REQUESTS

Seat requests, meal requests, wheelchair requests, special assistance, adjoining-room requests, bed preferences, vehicle preferences, or similar requests are generally requests only unless expressly confirmed by the Travel Supplier.

Glidova cannot guarantee that any such request will be fulfilled.

24. HOTEL BOOKINGS

Hotels and accommodation providers are solely responsible for the operation and condition of their properties.

Glidova does not independently guarantee:

  • hotel classification;

  • star rating;

  • room size;

  • bed configuration;

  • cleanliness;

  • amenities;

  • swimming pool availability;

  • restaurant availability;

  • internet availability;

  • accessibility;

  • views;

  • renovations;

  • noise levels;

  • location descriptions;

  • or service quality.

Descriptions are generally based on information supplied by Travel Suppliers or third-party data sources.

Facilities and amenities may change without prior notice.

25. HOTEL CHECK-IN REQUIREMENTS

Hotels may impose:

  • minimum check-in age;

  • identification requirements;

  • security deposits;

  • credit-card requirements;

  • incidental deposits;

  • local taxes;

  • resort fees;

  • occupancy restrictions;

  • and other property rules.

You are responsible for reviewing applicable requirements before travel.

26. CAR RENTAL BOOKINGS

A car rental reservation may be subject to requirements including:

  • minimum or maximum driver age;

  • valid driver's license;

  • International Driving Permit;

  • payment card;

  • security deposit;

  • insurance;

  • local address requirements;

  • driving history;

  • geographic restrictions;

  • mileage limits;

  • fuel policies;

  • and additional-driver conditions.

The rental-car company has final authority to determine whether the renter qualifies to receive the vehicle.

Glidova is not responsible if a rental company refuses to provide a vehicle because the traveler does not satisfy the rental company's requirements.

27. CAR RENTAL DAMAGE AND OPERATION

Glidova is not responsible for:

  • vehicle condition;

  • accidents;

  • personal injury;

  • traffic violations;

  • towing;

  • parking charges;

  • tolls;

  • fuel charges;

  • vehicle damage;

  • theft;

  • insurance disputes;

  • security deposits;

  • or conduct of the rental-car provider.

Such matters are governed by the rental agreement between the traveler and rental-car company.

28. ACTIVITIES, TOURS AND EXPERIENCES

Participation in activities may involve inherent risks.

These can include:

  • physical exertion;

  • transportation;

  • water activities;

  • outdoor activities;

  • wildlife;

  • heights;

  • extreme weather;

  • equipment;

  • sporting activities;

  • and other risks.

The activity provider is responsible for operating the activity.

To the maximum extent permitted by law, Glidova is not responsible for injuries, losses, accidents, delays, cancellations, or property damage arising from an activity provider's performance or operation.

This provision does not waive liability that applicable law prohibits Glidova from excluding.

29. CANCELLATION AND CHANGE REQUESTS

Cancellation and modification rights vary by booking.

A booking may be:

  • fully refundable;

  • partially refundable;

  • non-refundable;

  • non-changeable;

  • changeable with a fee;

  • or subject to a cancellation deadline.

You should review applicable fare or booking rules before purchase.

Where you request a change or cancellation:

  • supplier fees may apply;

  • Glidova service fees may apply where properly disclosed;

  • fare differences may apply;

  • availability may have changed;

  • and the supplier may reject the requested modification.

30. REFUNDS

Refund eligibility depends on:

  • applicable law;

  • supplier rules;

  • fare conditions;

  • cancellation reason;

  • booking status;

  • services already used;

  • and Glidova's role in the transaction.

Where a refund is legally required, mandatory legal requirements take precedence over contractual restrictions.

For voluntary cancellations, the applicable supplier and fare cancellation rules ordinarily apply.

Glidova is not required to provide a refund from its own funds merely because a supplier refuses a refund, except where Glidova has an independent legal obligation to do so.

31. REFUND PROCESSING TIME

Where a refund is approved or required, processing time may involve:

  • Travel Supplier approval;

  • GDS processing;

  • payment gateway processing;

  • acquiring-bank processing;

  • card-network processing;

  • issuing-bank processing;

  • and Glidova processing.

The time at which funds become visible in your account may therefore differ from the date on which a refund is initiated.

Where applicable law specifies a mandatory refund period, that legal requirement controls.

32. NO-SHOWS

Failure to use a reservation without properly canceling it may be treated as a no-show.

A no-show may result in:

  • cancellation of remaining flight segments;

  • forfeiture of the booking value;

  • loss of hotel payment;

  • cancellation of car rental;

  • loss of activity reservation;

  • or other supplier penalties.

Airline passengers should be aware that failure to use one flight segment may result in cancellation of subsequent segments under airline rules.

33. MISSED CONNECTIONS AND SEPARATE TICKETS

Where an itinerary consists of separate bookings, separate tickets, self-transfers, or separately contracted services, each booking may be legally independent.

Unless Glidova expressly represents otherwise, Glidova does not guarantee that one supplier will protect you if another supplier causes you to miss a separately booked service.

You are responsible for allowing sufficient transfer and connection time.

34. FORCE MAJEURE AND EVENTS OUTSIDE GLIDOVA'S CONTROL

To the maximum extent permitted by applicable law, Glidova is not responsible for failure, delay, cancellation, interruption, loss, or additional cost caused by circumstances outside Glidova's reasonable control.

Such events may include:

  • severe weather;

  • hurricanes;

  • floods;

  • earthquakes;

  • volcanic activity;

  • wildfires;

  • natural disasters;

  • epidemics;

  • pandemics;

  • public-health emergencies;

  • war;

  • armed conflict;

  • terrorism;

  • civil unrest;

  • strikes;

  • labor disputes;

  • government orders;

  • border closures;

  • travel restrictions;

  • sanctions;

  • embargoes;

  • airport closures;

  • air traffic control restrictions;

  • utility failures;

  • internet failures;

  • cyberattacks;

  • supplier system failures;

  • or similar events.

Refund rights, if any, remain subject to applicable law and supplier rules.

35. WEBSITE AND APPLICATION AVAILABILITY

Glidova does not guarantee uninterrupted or error-free operation of the Services.

The website or apps may occasionally be unavailable because of:

  • maintenance;

  • updates;

  • network outages;

  • hosting failures;

  • supplier API failures;

  • cybersecurity incidents;

  • technical errors;

  • third-party service failures;

  • or other causes.

To the maximum extent permitted by law, Glidova is not liable merely because a website, mobile application, search result, or booking interface becomes temporarily unavailable.

36. THIRD-PARTY API AND SUPPLIER DATA

Much of the travel information displayed by Glidova may originate from Travel Suppliers, APIs, GDS providers, aggregators, or other third parties.

Glidova does not warrant that third-party data will always be:

  • complete;

  • current;

  • accurate;

  • continuous;

  • error-free;

  • or available.

Supplier data may change without advance notice.

37. MAPS, DISTANCES AND LOCATION INFORMATION

Maps, distances, travel times, and location descriptions are provided for convenience.

Distances may be approximate.

Glidova does not guarantee the accuracy of:

  • map pins;

  • walking distance;

  • driving distance;

  • travel duration;

  • geographic descriptions;

  • or third-party map information.

Users should independently confirm a property's or activity's location where location is material to their booking decision.

38. USER ACCOUNTS

You may be required to create an account to access certain Services.

You are responsible for:

  • maintaining accurate account information;

  • maintaining confidentiality of your credentials;

  • protecting your password or authentication method;

  • and activities conducted through your account.

You must promptly notify Glidova if you believe your account has been compromised.

39. PROHIBITED USE

You may not use the Services to:

  • commit fraud;

  • make fraudulent reservations;

  • conduct unauthorized payment activity;

  • scrape or harvest data without authorization;

  • interfere with platform security;

  • reverse engineer the Services except where legally permitted;

  • introduce malware;

  • exploit pricing or technical errors;

  • impersonate another person;

  • create bookings using stolen credentials;

  • resell inventory without authorization;

  • overload Glidova systems;

  • interfere with supplier APIs;

  • circumvent security controls;

  • or violate applicable law.

Glidova may suspend or terminate access for suspected material violations.

40. INTELLECTUAL PROPERTY

Except for third-party content, the Glidova Services and associated intellectual property are owned by or licensed to Glidova.

This may include:

  • software;

  • application design;

  • website design;

  • branding;

  • graphics;

  • databases;

  • text;

  • logos;

  • interfaces;

  • search technology;

  • booking technology;

  • and other proprietary materials.

You receive a limited, revocable, non-exclusive, non-transferable license to use the Services for legitimate personal travel-related purposes.

No ownership rights are transferred to you.

41. THIRD-PARTY TRADEMARKS

Airline names, hotel names, supplier names, logos, and other third-party marks belong to their respective owners.

Their display through Glidova does not imply ownership by Glidova.

42. MOBILE APPLICATION LICENSE

Subject to these Terms, Glidova grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Glidova mobile application on a compatible device for personal lawful purposes.

You may not:

  • copy;

  • modify;

  • sell;

  • sublicense;

  • distribute;

  • reverse engineer;

  • create derivative works;

  • or commercially exploit

the application except where applicable law expressly permits such activity.

43. APPLE APP STORE TERMS

If you access the Glidova application through Apple's App Store, you acknowledge that these Terms are between you and Glidova, not Apple.

Apple is not responsible for Glidova's Travel Services.

Any rights Apple has as a third-party beneficiary under applicable App Store requirements are preserved.

44. GOOGLE PLAY TERMS

If you access Glidova through Google Play, your use may also be subject to applicable Google Play terms.

Google is not responsible for travel products supplied by independent Travel Suppliers through Glidova.

45. USER REVIEWS AND SUBMISSIONS

If Glidova permits reviews, comments, photographs, or other user content, you are responsible for content you submit.

You must not submit content that is:

  • unlawful;

  • fraudulent;

  • defamatory;

  • threatening;

  • infringing;

  • malicious;

  • or knowingly false.

Nothing in these Terms prohibits a consumer from making a truthful lawful statement about Glidova or its Services.

46. PRIVACY

Use of personal information is governed by the Glidova Privacy Policy.

By using the Services, you acknowledge that travel bookings may require Glidova to transmit traveler information to Travel Suppliers and other service providers as necessary to fulfill your booking.

47. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GLIDOVA SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

GLIDOVA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF:

  • AND OTHER THIRD-PARTY ACTIONS.

GLIDOVA'S DISPLAY OR FACILITATION OF A TRAVEL SERVICE DOES NOT CONSTITUTE A GUARANTEE OF THE SUPPLIER'S PERFORMANCE.

49. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GLIDOVA AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, LICENSORS, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

  • MISSED CONNECTIONS;

  • MISSED EVENTS;

  • LOST VACATION TIME;

  • SUBSTITUTE TRANSPORTATION;

  • SUBSTITUTE ACCOMMODATION;

  • OR OTHER CONSEQUENTIAL EXPENSES.

THIS EXCLUSION APPLIES EVEN IF GLIDOVA WAS ADVISED THAT SUCH DAMAGES COULD OCCUR.

50. LIABILITY CAP

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLIDOVA'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR BOOKING OR TRANSACTION SHALL NOT EXCEED THE GREATER OF:

(A) THE SERVICE FEES ACTUALLY RETAINED BY GLIDOVA IN CONNECTION WITH THE AFFECTED BOOKING; OR

(B) USD $100.

IF APPLICABLE LAW DOES NOT PERMIT THIS LIMITATION FOR A PARTICULAR CLAIM, THE LIMITATION SHALL APPLY TO THE MAXIMUM EXTENT LEGALLY PERMITTED.

THE FOREGOING LIMIT DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

51. MATTERS FOR WHICH GLIDOVA IS NOT RESPONSIBLE

To the maximum extent permitted by applicable law, Glidova is not responsible for loss arising from:

  • supplier negligence;

  • supplier insolvency;

  • supplier bankruptcy;

  • supplier operational failure;

  • weather;

  • natural disasters;

  • airline schedule changes;

  • flight cancellations;

  • missed connections;

  • hotel conditions;

  • hotel overbooking;

  • rental-car denial;

  • activity cancellation;

  • government actions;

  • visa denial;

  • passport problems;

  • border refusal;

  • customs action;

  • or other circumstances outside Glidova's reasonable control.

Nothing in this section excludes a statutory obligation that applicable law expressly imposes upon Glidova.

52. NO LIABILITY FOR TRAVELER CONDUCT

Glidova is not responsible for any action, omission, misconduct, violation, criminal activity, negligence, or unlawful behavior of a Traveler or other user.

Users are solely responsible for their own:

  • behavior;

  • compliance with law;

  • compliance with supplier rules;

  • travel documentation;

  • decisions;

  • activities;

  • and conduct while traveling.

53. PERSONAL INJURY AND PROPERTY DAMAGE

Except to the extent Glidova is directly legally responsible and such liability cannot lawfully be excluded, Glidova is not liable for personal injury, death, accident, illness, property damage, property loss, theft, or other physical harm caused by an independent Travel Supplier or third party.

Claims arising from the actual operation of a Travel Service should generally be directed to the party operating that service.

54. INDEMNIFICATION

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Glidova and its affiliates, officers, directors, employees, contractors, representatives, and agents from claims, liabilities, damages, losses, and reasonable expenses arising out of or relating to:

  • your violation of these Terms;

  • your misuse of the Services;

  • fraudulent activity;

  • information you provide concerning another traveler without proper authority;

  • your violation of applicable law;

  • your infringement of another person's rights;

  • or your conduct in connection with a Travel Service.

This provision does not require you to indemnify Glidova for liability to the extent caused by Glidova and non-waivable under applicable law.

55. RELEASE REGARDING THIRD-PARTY DISPUTES

To the maximum extent permitted by law, disputes arising solely between you and an independent Travel Supplier should be resolved with that Travel Supplier.

You release Glidova from claims arising solely from the acts or omissions of such independent supplier, except where Glidova has an independent legal responsibility that cannot lawfully be waived.

56. CUSTOMER SUPPORT

Glidova may assist users with:

  • booking questions;

  • supplier communications;

  • cancellation requests;

  • refund requests;

  • booking modifications;

  • and technical issues.

Such assistance does not make Glidova legally responsible for the underlying actions of a Travel Supplier.

Glidova cannot guarantee that a supplier will grant a discretionary request.

57. COMMUNICATIONS

You agree that Glidova may communicate with you regarding your bookings and use of the Services through:

  • email;

  • SMS;

  • telephone;

  • push notification;

  • in-app message;

  • or other reasonable communication channels.

You are responsible for maintaining accurate contact information.

Glidova is not responsible if you fail to receive a material travel communication because you supplied incorrect contact information, blocked communications, disabled notifications, or failed to monitor your communications.

58. ELECTRONIC CONTRACTING

You agree that:

  • electronic acceptance;

  • electronic records;

  • electronic confirmations;

  • electronic tickets;

  • electronic vouchers;

  • and electronic communications

may satisfy applicable written-document requirements to the extent permitted by law.

59. SUSPENSION OR TERMINATION

Glidova may restrict, suspend, or terminate access to the Services where reasonably necessary because of:

  • fraud;

  • security concerns;

  • abuse;

  • unlawful activity;

  • material breach of these Terms;

  • supplier requirements;

  • or risk to Glidova or other users.

Termination does not automatically cancel an otherwise valid confirmed Travel Service unless cancellation is independently authorized.

60. CHANGES TO SERVICES

Glidova may change, add, remove, discontinue, or modify website or application functionality.

Glidova is not obligated to permanently maintain any particular:

  • interface;

  • feature;

  • supplier;

  • destination;

  • integration;

  • mobile functionality;

  • or search function.

Existing confirmed bookings remain subject to applicable contractual and legal obligations.

61. CHANGES TO THESE TERMS

Glidova may modify these Terms periodically.

Changes may reflect:

  • new Services;

  • supplier arrangements;

  • operational changes;

  • changes in technology;

  • security requirements;

  • or changes in law.

The updated version will include a revised "Last Updated" date.

Where required by applicable law, material changes will be communicated or consent obtained as appropriate.

62. GOVERNING LAW

Except where federal law applies or applicable consumer law requires otherwise, these Terms shall be governed by the laws of the State of Illinois, without regard to conflict-of-law rules.

Mandatory consumer rights provided by the law of your jurisdiction remain unaffected where they cannot lawfully be waived.

63. INFORMAL DISPUTE RESOLUTION

Before commencing arbitration or litigation, you and Glidova agree to attempt in good faith to resolve the dispute informally.

A claimant should provide written notice describing:

  • the claimant's name;

  • booking reference if applicable;

  • nature of the dispute;

  • relevant facts;

  • and requested resolution.

Notice should be sent to:

Glidova Inc.
Attn: Legal Department
2500 W. Higgins Rd, STE 1276
Hoffman Estates, IL 60169
United States

Email: [INSERT GLIDOVA LEGAL EMAIL]

The parties will have at least thirty (30) days after receipt of a complete dispute notice to attempt informal resolution before filing arbitration, except where immediate injunctive relief is reasonably necessary or applicable law provides otherwise.

64. BINDING INDIVIDUAL ARBITRATION

PLEASE READ THIS SECTION CAREFULLY.

Except for disputes that qualify for small claims court and claims for which applicable law prohibits mandatory arbitration, you and Glidova agree that disputes arising out of or relating to:

  • these Terms;

  • the Glidova Services;

  • a booking made through Glidova;

  • payments;

  • communications;

  • or your relationship with Glidova

shall be resolved through binding individual arbitration rather than a trial in court.

The arbitration shall be administered by the American Arbitration Association ("AAA") under the applicable AAA Consumer Arbitration Rules, unless the parties agree otherwise.

The Federal Arbitration Act shall govern the interpretation and enforcement of this arbitration agreement to the extent applicable.

The arbitrator may award the same individual remedies available in court, subject to lawful limitations contained in these Terms.

65. CLASS ACTION WAIVER

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND GLIDOVA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY.

NEITHER PARTY MAY BRING OR PARTICIPATE IN A CLAIM AS:

  • A CLASS ACTION;

  • CLASS ARBITRATION;

  • REPRESENTATIVE ACTION;

  • COLLECTIVE ACTION;

  • OR PRIVATE ATTORNEY GENERAL ACTION,

TO THE EXTENT SUCH WAIVER IS ENFORCEABLE UNDER APPLICABLE LAW.

If a court determines that this waiver is unenforceable for a particular claim or remedy, that issue shall be handled as required by applicable law.

66. ARBITRATION OPT-OUT

You may opt out of the arbitration agreement by providing Glidova written notice within 30 days after first accepting these Terms.

The notice must include:

  • your full name;

  • email address associated with your Glidova account, if any;

  • mailing address;

  • and an express statement that you wish to opt out of the arbitration agreement.

The notice must be sent to:

Glidova Inc. – Arbitration Opt-Out
2500 W. Higgins Rd, STE 1276
Hoffman Estates, IL 60169
United States

or:

Opting out of arbitration does not opt you out of any other provision of these Terms.

67. SMALL CLAIMS COURT

Notwithstanding the arbitration provision, either party may pursue an eligible individual claim in a small claims court of competent jurisdiction.

68. JURY TRIAL WAIVER

TO THE EXTENT A DISPUTE IS PERMITTED TO PROCEED IN COURT AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH PARTY KNOWINGLY WAIVES THE RIGHT TO A TRIAL BY JURY.

69. COURT VENUE

For disputes not subject to arbitration and not eligible for another mandatory venue under applicable law, the parties consent to the jurisdiction of appropriate state or federal courts located in or serving Cook County, Illinois, unless applicable law requires otherwise.

70. TIME LIMIT FOR CLAIMS

To the extent legally permissible, any claim arising out of or relating to the Glidova Services must be commenced within one (1) year after the claim arose.

If applicable law requires a longer period or prohibits contractual shortening of the limitations period, the statutory period will apply.

71. SEVERABILITY

If any provision of these Terms is held unlawful, void, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect unless applicable law requires otherwise.

72. NO WAIVER

Failure by Glidova to enforce a provision of these Terms does not constitute a waiver of that provision or any other provision.

73. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without Glidova's prior written consent.

Glidova may assign these Terms in connection with:

  • a merger;

  • acquisition;

  • corporate reorganization;

  • asset sale;

  • financing;

  • or transfer of the applicable business,

subject to applicable law.

74. NO THIRD-PARTY BENEFICIARIES

Except where expressly provided, these Terms do not create enforceable rights for third parties.

75. ENTIRE AGREEMENT

These Terms, together with the Glidova Privacy Policy, applicable booking conditions, displayed supplier conditions, and policies expressly incorporated by reference constitute the agreement between you and Glidova regarding your use of the Services.

76. CONFLICT WITH MANDATORY LAW

Nothing in these Terms is intended to:

  • waive a right that cannot legally be waived;

  • eliminate a statutory refund obligation;

  • exclude liability that applicable law prohibits Glidova from excluding;

  • misrepresent consumer rights;

  • or prevent a consumer from contacting a regulator or government agency.

If any provision conflicts with mandatory applicable law, mandatory law controls only to the extent of the conflict.

All remaining provisions remain effective.

77. NO PROFESSIONAL ADVICE

Information provided through Glidova is intended for travel-booking and general informational purposes.

Glidova does not provide:

  • legal advice;

  • immigration advice;

  • medical advice;

  • financial advice;

  • tax advice;

  • or insurance advice,

unless such service is expressly identified and provided by a properly authorized professional.

78. USER ACKNOWLEDGMENT OF TRAVEL RISKS

By booking travel through Glidova, you acknowledge that travel can involve risks and circumstances outside Glidova's control.

These may include:

  • transportation disruptions;

  • accidents;

  • illness;

  • crime;

  • political instability;

  • weather;

  • supplier failure;

  • border restrictions;

  • local laws;

  • and other travel risks.

You are responsible for evaluating whether travel to a destination is appropriate for you.

79. TRAVEL ADVISORIES

Glidova may provide or link to governmental travel information as a convenience.

Travelers should independently consult appropriate governmental resources and travel advisories before departure.

Glidova does not guarantee the completeness or currency of third-party travel-advisory information.
